West Virginia Infectious Waste Regulations 


Facilities such as hospitals and nursing homes are subject to stringent operational guidelines in West Virginia; the Office of Environmental Health Services Public Health Sanitation Division and OSHA manage these regulations. In West Virginia medical waste is referred to as IMW (Infectious Medical Waste), all generators of infectious waste are required to implement an IMW management plan that outlines how they store, treat and dispose of their medical waste. 

Any healthcare facility generating more than 50 lbs. per month must apply to the Office of Environmental Health Services Public Health Sanitation Division for an annual permit, as well as submitting their IMW Plan for approval. All other infectious medical waste not including sharps must not be stored for more than 30 days prior to transportation to an approved infectious medical waste management facility, even if refrigerated. All hospitals and nursing homes in West Virginia are required to have medical and biohazardous waste removed from their facility at a minimum on a daily basis.

Waste Classification

In West Virginia, Infectious medical waste is classified as waste generated in the diagnosis, treatment or immunization of human beings or animals which has been or is likely to have been contaminated by an organism capable of causing disease in healthy humans. IMW includes items such as: cultures and stocks of microorganisms and biologicals; blood and blood products; pathological wastes; sharps; animal carcasses, body parts, bedding and related wastes; isolation wastes; any residue resulting from a spill cleanup; and any waste mixed with or contaminated by infectious medical waste.

Storage Requirements

West Virginia state requirements mandate:

Storage rules apply at any time after packaging (sealing) for transport, including time spent during transportation and at all treatment and disposal sites or facilities. Infectious medical waste other than sharps shall not be stored for more than thirty (30) days prior to transportation to an infectious medical waste management facility, even if refrigerated: Provided, that the total amount of storage time, including transportation to an infectious medical waste management facility, shall not exceed forty-five (45) days. Facilities that treat infectious medical waste on-site must not store the infectious medical waste more than thirty (30) days.
